Negligence at South Carolina (SC) Rehab Hospital Causes Patient to Develop Severe Bedsores

A jury has ruled in favor a woman who brought a medical negligence and malpractice suit against a nursing home she alleged failed to provide a minimum standard of care to her paralyzed husband, causing him to develop near-fatal bedsores.

A South Carolina (SC) jury has ruled in favor a woman who brought a medical negligence and malpractice suit against a nursing home she alleged failed to provide a minimum standard of care to her paralyzed husband. According to trial testimony summarized in The (Columbia, SC) State, Vernon Sulton developed bedsores, including one “the size of a saucer plate,” while lying on his back for weeks at the HealthSouth Rehabilitation Hospital in the Palmetto State’s capital city.

Sulton had been admitted to the rehab hospital after being paralyzed from his chest down by a gunshot. Skin damage and a severe infection resulting from the bedsores — which doctors and nurses often call a pressure sores – required Sulton to wear a colostomy bag and undergo numerous reparative surgeries. He has since died from causes unrelated to the bedsores and their complications.

Jurors awarded Sulton’s widow $4 million in actual damages and $8 million in punitive damages. At least some of that verdict will be reduced because South Carolina, like Virginia (VA) and many other states, has a cap on noneconomic damages in medical malpractice cases.

Nurses and physical therapists have a duty to regularly reposition bed-bound hospital patients to prevent bedsores. When they fail to do so, and when doctors fail to make sure patients get turned, the results can be further debilitating or even deadly. I’m pleased to see that the members of the South Carolina jury held the health professionals accountable for the mistakes in providing proper care for a a paralyzed patient.
