New Study Finds Many COPD Patients Are Being Prescribed Dangerous Drugs

By Mark Favaloro, Medical Malpractice Injury Lawyer

What happened:

The publication Drugs and Aging recently reported on a Canadian study that found that a popular class of drugs commonly used to treat sleep and mood symptoms are still frequently prescribed to patients who suffer from chronic obstructive pulmonary disease (COPD) despite being known to have potentially life-threatening side effects. The drugs are referred to as benzodiazepines and include medications such as Ativan, Klonopin, Serax, Valium and Xanax.

COPD involves constriction of the airways, leaving the patient with difficulty or discomfort in breathing, such as emphysema and chronic bronchitis. Many COPD sufferers are being prescribed benzodiazepines for symptoms of insomnia, depression, anxiety and shortness of breath.

But benzodiazepines are known to potential respiratory-related side effects, affecting breathing ability and oxygen levels at night. These drugs also affect memory loss, decrease alertness, cause falls and increase the risk of motor vehicle accidents. More alarming is that researchers discovered that 35.4% of new use of benzodiazepines occurs during an exacerbated episode of COPD.

Dr. Nicholas Vozoris, a respirologist and lead author of the study said, “These findings are new and they are concerning because they tell us that the patients most at risk to be affected by the adverse effects of this drug are the same ones that are using it with the most frequency.”

The Virginia Injury Lawyer Perspective:

There are many drugs on the market that cause serious side effects, particularly in those patients they claim to help. It’s disturbing that physicians would be prescribing benzodiazepines to COPD patients who are at a high risk of experiencing those dangerous side-effects. Our personal injury law firm has reported on other dangerous drugs which have had tragic consequences for many patients.

Our personal injury lawyers have also represented many clients in dangerous drug and medication cases. Tragically, some of those incidents were wrongful death cases. If you or a family member has suffered serious side effects caused by a dangerous drug, contact a Virginia personal injury attorney.

Benzodiazepines can be dangerous for patients who suffer from COPD.

South Carolina Lawmakers Consider Mandatory Screening of Newborns for Congenital Heart Defects

By Randy Appleton, Medical Malpractice Injury Lawyer

What happened:

Lawmakers in South Carolina are currently considering a bill that would require birthing facilities licensed by the state Department of Health and Environmental Control to perform a pulse oximetry screening on newborn in first two days of life. Pulse oximetry can identify infants with congenital heart defects (CHD). Without screening, some newborns with CHDs might be missed because the signs of CHD may not be evident before an infant is discharged from the hospital after birth.

The Emerson Rose Act is named after a South Carolina baby who was born with a CHD. Emerson Rose had open heart surgery at four days old, but died a little over two months later.

The screening process is painless and involves a placing a sensor on a baby’s finger or foot to measure oxygen levels. The cost of the test, according to the CDC, is only $5 to $10.

CHDs are the number one birth defect in the United States today. More than 44,000 infants (almost one out of one hundred) are born with heart defects each year. That is 1 every 15 minutes.

The North Carolina Injury Lawyer Perspective:

Tragically, twenty percent of children with CHD will not survive past their first birthday. Nearly twice as many children die from congenital heart disease in the United States each year as die from all forms of childhood cancers combined. Too many CHD diagnoses are missed by medical staff. This simple test could give many of these infants the proper medical care they need to survive.

If you or a family member has suffered because of a physician’s missed diagnosis, contact a North Carolina medical practice attorney to find out what compensation you may be entitled to for your pain and loss.  Our medical malpractice firm has successfully represented many clients who have suffered from a doctor’s failure to diagnosis.

Surgeon Operates on 4-Year-Olds Healthy Eye by Mistake

By Mark Favaloro, Virginia (VA) Medical Malpractice Lawyer

What Happened

In 2011 a surgeon operated on the healthy eye of a 4-year old. Now his parents are pursuing a malpractice claim against the hospital and surgeon that operated on the incorrect eye. In 2011, the eye surgeon was supposed to operate on their son’s right eye to stop it from wandering. According to the parents the surgeon started the operation on their son’s left eye then realized the mistake and repeated the same operation on the right eye. When they were notified they state the doctor stated, “Frankly, I lost sense of direction and didn’t realize I had operated on the wrong eye until I was done operating on the eye.”

Here is a news video about the surgical mistake and malpractice claim.

The hospital has offered $50,000 to settle out of court and to not publicly acknowledge the mistake. The parents however say they will still pursue a malpractice claim because they want to the surgeon and hospital to be held accountable and admit to their mistake.

The Virginia Personal Injury Lawyers’ Perspective

Though surgeons are well trained and often highly skilled, mistakes are still made and wrong site surgeries can occur. According to the latest statistics, officials estimate that wrong site surgery occurs 40 times a day in US hospitals and clinics. Wrong site surgery is a problem across the nation and only half of the 50 states are required to report mistakes made in surgery. Wrong site surgical errors can be devastating to a patient’s health and leave them with serious consequences such as unnecessary physical and emotional stress potentially causing other health complications, unnecessary tissue damage or depending on the procedure, amputation, and even possible need for otherwise unnecessary or extended physical therapy. If you or a loved one has been the victim of a surgical error or wrong site surgery, you should consult with an experienced Virginia (VA) medical malpractice lawyer for this type of medical malpractice lawsuit. Our firm enjoys a reputation of experience and success while representing victims in medical malpractice cases against doctors, hospitals, and other health care providers. We approach each case individually to provide the resources, knowledge and experience to achieve success on behalf of our clients.
