West Virginia Birth Injury Lawsuit Settled for $5.3 Million

The parents of a baby with cerebral palsy have been awarded a settlement of $5.3 million this week, after the East Coast hospital agreed to settle. Though settlements of this size are not uncommon for birth injury suits, no amount of compensation can ever make up for the life-changing injury of a newborn baby. Sadly, medical malpractice cases are all too common in the United States.

In this situation, the plaintiff alleged that the hospital did not provide enough medical attention to the situation at hand. The mother visited the hospital several times throughout her pregnancy but still delivered a full eight weeks early. She and her family believe the early delivery could have been prevented if the hospital staff had taken appropriate measures.

In order to win a medical malpractice suit like this one, plaintiffs have to prove that a healthcare provider or institution failed or neglected to provide standard treatment or care. The family in this case must have proved their case, as the hospital chose to settle for $5.3 million. Medical evidence is often the deciding factor in medical malpractice suits. Malpractice Award for Virginia Woman Who Suffered Birth Injury Upheld on Appeal

Cerebral Palsy Victim Wins $144M Award in Michigan Malpractice Lawsuit

Cerebral Palsy Caused by Medical Negligence Results in $29M Verdict for Family

The government, which operated the health center where the newborn suffered his brain injury, had appealed the initial judgment.

A Gurnee, Illinois (IL), family whose son developed cerebral palsy shortly after being born in 2003 will receive $29 million in a medical negligence verdict against the government-run health center whose doctors and nurses mistreated the newborn’s blood infection. As the Chicago Sun-Times reported on September 3, 2011, the judgment had to be upheld by a federal appeals court after the government argued the facility it controlled and the health care practitioners it employed could not be held liable for causing the infant’s brain injuries because his parents had waited longer than 2 years to file a personal injury lawsuit.

The boy, the newspaper notes, is now a “spastic quadriplegic” who “requires a lot of care.”

This video from the Johns Hopkins University School of Medicine describes the causes, symptoms and lifelong complications of cerebral palsy. While watching the cerebral palsy overview, keep in mind that the brain injuries and infections a child suffers in the womb or during delivery can often be attributed to medical negligence or malpractice. Also keep in mind that children born with CP often require a lifetime of specialized health care to help them live well despite suffering movement disorders, mental impairments and  physical disabilities.

$3.5 Million Medical Malpractice Jury Verdict Featured in Virginia Lawyers Weekly

Brain Injured Woman Feels no Fear

Jury awards $2.3 Million Dollars to Child for Birth Injury

On Friday, a Virginia (VA) jury awarded $2.3 million in damages to a 4 -year-old boy who suffered arm injuries at birth, reports The Virginian Pilot.  The Circuit Court jury also awarded $60,000 to the child’s mother for reimbursement of medical expenses. 

Although I am sure it is a relief to the mother that she will be able to use the settlement to provide for her child.  It can never make up for the fact that someone’s mistake at the time of birth has changed the course of her child’s life forever.  The little child now has a permanently disabled right arm.  As a mom myself I can’t imagine how upset I would feel, if someone was to permanently injure my child.

The lawsuit named a nurse-midwife as the at-fault party.  We fully appreciate the midwife had no intention of seriously injuring the baby, but she had to be held accountable when an error occurred, just like everyone else.
